Privacy Policy

1. General information

1.1 Limine BV is a legally registered company in accordance with Belgian law having its registered offices in 3080 Tervuren (Belgium), Victor Van Espenlaan 3 and registered under the company number 0772.713.084 (hereafter “Limine”). Any reference in this Privacy & Cookies Notice to “we”, “us” or “our” will be meant to designate Limine.

Limine processes as controller the personal data of certain persons (hereafter “data subject”).

This privacy and cookie notice (hereafter “Privacy Notice”) is addressed to the following persons: consultants, clients, companies and interested parties.

We recommend to read carefully this Privacy Notice as it contains your rights vis-à-vis Limine.  This Privacy Notice may be amended from time to time and we advise you to verify regularly our Privacy Notice.

1.2 Limine considers the privacy and protection of personal data of the concerned persons as an important matter.  Limine is committed to adhere to the General Data Protection Regulation of 27 April 2016 (hereafter “GDPR”) as well as the Law of 30th of July 2018 relating to the protection of privacy and its executive orders (hereafter “Law of 30 July 2018”) and any other applicable regulation in relation to the protection of personal data.  Limine takes all reasonable measures to ensure that personal data provided to us will remain properly handled, confidential where appropriate and safely protected.

1.3 The Privacy Notice is published on our website (latest version October, 1 2021) and explains why and how we collect and process, your personal data set forth in Article 2 of the Privacy Notice when you use our services, visit our website, use our (mobile) application or interact with us. This Privacy Notice also instructs you how to exercise your rights relating to your personal data.

2. Personal data

2.1 When using Limine’s services, visiting our website or contacting and interacting with us, you may provide us with your personal information voluntarily which is collected on an individual basis.

This includes:

– Electronic identification data (IP-addresses, MAC-address, cookies, connection tools, electronic device identifier);

– Identification data : surname, name, title, picture, photos, signature, national registry number, VAT number, address, phone number, e-mail address,  gender, date of birth, place of birth, marital status, nationality;

– Professional and educational data: CV, including motivation letters, references, qualifications, professional background information, interview reports, publications, social media profiles, languages, hobby, interests, previous work experience, current and previous title and description of the function, date of recruitment, workplace, specialization or type of enterprise, employment modalities and requirements, including motivation letters, references, qualifications, professional background information, languages, hobby, interests), employer, title and description of the function, date of recruitment, workplace, specialization or type of enterprise, employment modalities and requirements, previous positions at the current employer, obtained qualifications and competences, diploma’s, etc.;

– Data related to salary, budget and payments : daily/hourly rate and required budget, bank account number.

2.2. Limine also processes public data such as data of which’s publication is mandatory, such as the publication of your appointment as administrator of a company in the Crossroads Bank for Enterprises, or data which you published yourself, for instance on your website or LinkedIn or social media, or data which is publicly known.

 

3. Purposes and legal grounds

3.1 Limine processes your personal data solely for the following purposes:

Electronic identification dataTo operate, improve and protect the website, platform and services of Limine based on the legitimate interests of Limine to improve its website, platform and services continuously and to guarantee its growth and good functioning in view of business development activities; to verify identity, assist with identification of users and performance of the application; to receive information, comments, suggestions, claims of users to improve the service quality of Limine.
In any event, Limine’s legitimate interests may and shall not override the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

Identification dataTo provide our customized services and to be able to make the right connections between corresponding profiles and assignments of companies; to provide the requested information and/or services; to optimize our services; to verify identity, assist with identification of users and performance of the application; to communicate with you; to receive information, comments, suggestions, claims of users to improve the service quality of Limine; to comply with legal obligation.
This personal data is processed on the basis of your previous consent or to perform our contractual obligations.Professional and educational dataTo allow you to be considered and assessed as a suitable candidate in relation to an assignment; to be contacted by Limine or a client of Limine; to evaluate your application, to set up interviews and to assess the outcome of the interviews; to optimize our services; to provide our customized services and to be able to make the right connections between corresponding profiles and assignments of companies. This personal data is processed on the basis of the execution of our contractual obligations or your previous consent.Data related to salary, budget and paymentsTo be able to make the right connections between corresponding profiles and assignments of companies; to provide the customized services; to make payments.  This personal data is processed on the basis of the execution of a contract.

3.1.2 Your consent may always be withdrawn in accordance with article 8.  The withdrawal of consent shall only affect the future and does not affect the lawfulness of processing your personal data based on your consent before the withdrawal.   You may also always refuse to provide Limine with your personal data.  However, this refusal may prevent Limine to provide you all or part of the services, which you may have requested from us in full quality.  The same applies if you provide Limine with incomplete or inaccurate information which is required for the execution of Limine’s contractual obligations or for compliance with a legal obligation,

3.1.3 When we process your personal data on the basis of our legitimate interests or those of a third party, Limine ensures that a balance of these interests against your legitimated interests with respect to the protection of your personal data has been done.  When necessary we have taken appropriate measures to limit implications and prevent unwarranted harm to you.

3.2 Direct marketing

Limine intends to use your personal data for direct marketing purposes, or transfer such personal data to any of Limine’s affiliates, related companies or existing clients of Limine.  Direct marketing shall include, without limit, regular sending of e-mail alerts, announcements, updates, festive greetings and/or invitations to events. The purpose is to keep you up to date with information and other areas of interest, and to market Limine’s services.  The processing of this personal data is based on the legitimate interest of Limine to ensure the functioning and growth of our company and for business development activities.  These legitimate interest may and shall not override your interests or fundamental rights and freedoms which require protection of personal data.  Before sending any direct marketing to consultants or prospects or visitors of our website, your explicit consent shall be requested.  You may always withdraw your consent, without charge or motivation, in accordance with article 8.

 

4. Disclosure to third parties

4.1 Limine shall not share your personal data with any third parties, except as outlined below.

4.2 Limine may disclose certain personal data to third parties, such as employees of Limine, undertakings of Limine’s group (undertakings of DMB Solutions BV) and strategic partners that work with Limine to provide products and services and that provide technical and operational back up as well as to third parties in general (such as lawyers, auditors, experts, etc.) that might assist us in business development activities.

4.3 Based on the explicit consent of the consultant, Limine may transfer your personal data to its partners in order to offer extra services.

4.4 Furthermore, Limine may be required by law and/or legitimate requests from governmental bodies to disclose your personal data.

4.5 Limine may disclose personal data, on a legitimate basis, if Limine determines that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or activities or users.

4.6 In the event of a reorganization, merger, or sale of Limine, we may transfer certain or all personal data to the relevant third party.

4.7 Limine shall use its best endeavors to ensure that its employees and other partners, involved in the processing of personal data, will observe and adhere this Privacy Notice.

 

5. Data transfer to third countries

Limine may transfer your personal data to our contractual partners located in countries outside the European Economic Area in accordance with this Privacy Notice.  In the event this data transfer happens to country which does not ensure an adequate level of protection, Limine undertakes to guarantee the processing of your personal data in accordance with the GDPR, including the ensurance of appropriate level of safeguard and binding corporate rules.

 

6. Protective technical and organizational measures

We take the necessary administrative, technical and organizational measures to ensure the security and confidentiality of your personal data and we protect your personal data against accidental loss, misuse, unauthorized access, disclosure, alteration and accidental or unauthorized destruction.

In view of the processing of your personal data, our personnel or agents need access to your personal data.  This access is only on a need-to-know basis and only to the extent necessary to provide our services.

Prior to providing access to any personal data to any personnel or agents, Limine shall take reasonable steps to ensure continuing compliance of the required level of security by such personnel or agents. The personnel or agents with access to personal data are subject to confidentiality obligations, and these are formally integrated into contractual clauses.

 

7. Retention period

Limine will store your personal data for the period necessary to fulfill the purposes for which we process this personal data as set forth in article 3 of this Privacy Notice, except a longer retention period is required or permitted by law.  Unless you have become a consultant or a client, Limine will only store your personal data for as long as you are a possible prospective consultant or client to Limine or for as long as your information is relevant to evaluate the functioning of our website, platform and services.

 

8. Your rights

8.1 Your rights are the following:

  • The right of access: you have the right to ask us to provide access to your data;
  • The right to information: you have the right to ask us to provide more information whether and to what extent your data is processed;
  • The right to rectification: you have the right to obtain from Limine the rectification of inaccurate or incomplete personal data concerning you.
  • The right to object to the processing: you have the right to object to the processing of your personal data for prospecting and marketing purposes, including profiling and direct marketing;
  • The right to deletion: you may ask us to delete your personal data;
  • The right to withdraw consent: when the processing of your personal data is subject to your prior consent, you have the right to withdraw your consent at any time.
  • The right to restriction of processing: You have the right to request a limitation of the processing of your personal data without deleting the personal data concerned on the conditions stated in the GDPR;
  • The right to data portability: You have the right to request that we provide your personal data to you in a machine-readable format if the processing is carried out by automated means.
  • Rights in relation to automated decision making and profiling: you have the right to object to automated decisions that were taken based on automated processing only of your personal data.

If you no longer wish to receive direct marketing or promotional e-mails (newsletters, publications, invitations to our seminars, etc.) from Limine, you can unsubscribe at any moment, free of charge, by sending an e-mail to info@limine.be, by clicking the ‘unsubscribe’ link in our e-mails or by completing the contact form on our website.

9. Cookies

9.1 “Cookies” are used by Limine is some parts of its website and applications in order to provide enhance you user experience and service tailored to your personal preferences. We also use the cookies for optimizing our website and in some cases, essential to making it work. Certain cookies also allow us to gather data for marketing purposes.

9.2 Cookies are small text files placed on the hard disk of website visitors’ computers and/or devices. They retain certain information, such as visitors’ language preference or the contents of the shopping basket.
